1.    Acceptance of Terms


By accessing and ordering products on the Site, and by providing some Personal Information (as defined below) to A. Vogel through the Site, you confirm your agreement to be subject to the terms and conditions of the present Privacy Policy. If you do not accept these terms and conditions, please do not access or use the Site and provide Personal Information via the Site.


We reserve the right to change this Privacy Policy at any time by updating the present document. Any changes to the Privacy Policy will enter into force thirty (30) days after its publication on the Site.


2.    A. Vogel Respects Your Privacy


A. Vogel is determined to protect the privacy of all of the Site's users and to maintain the integrity of all information identifying a person ("Personal Information") that it gets, uses, holds or discloses through the Site. The purpose of the present Privacy Policy is to inform you of why and how we obtain Personal Information on the Site, to inform you of the ways that we take to protect Personal Information and to provide you with a contact number at A. Vogel in the event that you have any questions or concerns about our privacy practices.


A. Vogel respects your privacy. That is why we have developed comprehensive procedures and practices relating to the management of Personal Information.


3.    General Information


The present Privacy Policy describes the Personal Information that A. Vogel may collect from the Site's users as part of its normal supply of services and also describes the use that can be done of that Personal Information.


Our primary goal in collecting Personal Information about you is to make sure that your experience on the Site happens in a safe, quiet, efficient and personalized matter. Thus, we can deliver the services and features that best fit your needs and customize our services to make your experience safer and friendlier. We only collect the Personal Information that we deem necessary to achieve this goal.


In general, you can browse the Site without needing to disclose your identity or Personal Information. Once you submit your Personal Information, you are no longer an anonymous person to us. A. Vogel's Internet servers can get information, in a passive and automatic way, on the browsing habits of the Site's users, which can be linked to their Internet Protocol ("IP") addresses (which are unique Internet addresses assigned to all Internet users by their Internet service providers). The servers' databases may record statistical information such as the users' IP addresses, the type of operating system used, the time and duration of visits and pages requested. They can also identify categories of users based on the theme as the domain name or the type of browser. Such statistical information is usually collected and used by A. Vogel in a way that does not identify users of the Site.


The Site may use other cookies. Cookies are small text files placed at the occasion of a consultation by the Site's server on the hard drive of the Site's users to memorize information attached to the browser used by the latter when it browses a Website. Cookies can be stored on your hard drive or on a temporary file in which case they are erased when you turn off your computer browser. 4.    Special Note on Children


Children (persons under the age of eighteen (18)) may not use the Site without supervision. In addition, we ask them not to give us Personal Information. If you are under eighteen (18) years of age, you can use this Site only under the supervision of your parents or guardian.


5.    Why A. Vogel collects Personal Information

A. Vogel collects Personal Information only for the following reasons :

  • to announce, develop, improve and provide products and services to users of the Site;
  • to facilitate access to services for users of the Site;
  • to measure and improve the effectiveness of A. Vogel's products and services as well as its marketing tools;
  • to manage and expand A. Vogel's operations, including the management of it sales or of some of A. Vogel's business;
  • to settle disputes;
  • to charge the Site's users' accounts;
  • to help promote safe trade;
  • to inform the Site's users of offers, products, services and online or offline updates;

6.    Does A. Vogel disclose your Personal Information?

There are a variety of circumstances in which we may be required to disclose Personal Information to third parties. For example, A. Vogel may disclose Personal Information to third parties hired to perform functions on our behalf or to a public authority or an agent of a public authority if, upon reasonable notice by A. Vogel, it appears that there is an imminent threat to the life or to private property that could be avoided or minimized by the disclosure of that information.

7.    How A. Vogel protects your Personal Information?

Vogel employees who have access to Personal Information receive training on how to protect your privacy. All computers on which is stored Personal Information are protected by passwords. A. Vogel also uses data encryption for increased security of the Personal Information that you provide through the Site.


8.    Managing your password


You are responsible for any actions taken using your user name and password, including fees charged to your account. We recommend that you never reveal you're A. Vogel password to any third party. If you choose to share your user name and password or your Personal Information with third parties, you will be liable for any actions taken through your account and you therefore have an interest in reading the privacy policy of this third party beforehand. If you disclose your password, you may lose considerable control over your Personal Information and you may take the risk that legally binding actions be taken on your behalf. 9.    Your Consent / Audits and Amendment of Personal Information


You can withdraw your consent to A. Vogel's management of your Personal Information by sending us a written request at the address given below, subject to legal and contractual restrictions, upon reasonable notice. However, it will reduce our ability to provide you with certain products and services. You can contact A. Vogel for more information on the implications of withdrawing your consent.


You can also access and review your Personal Information held by A. Vogel and make any necessary changes by contacting A. Vogel. It may be asked that you to make your request in writing and attach a proof of your identity. The reason why we ask for identification documents is to ensure, among other things, that we do not disclose unintentionally your Personal Information to a third party claiming to be you.

The courts of the District of Montreal, in the Province of Quebec, have exclusive jurisdiction to hear any dispute related to the present Privacy Policy, including its interpretation and its effects.
